Terms and Conditions
- Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
- Entry is open to residents of New Zealand (“Eligible Entrant”). Any entrant who is under the age of 18 years must have their parent or guardian’s permission to enter the promotion. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
- The “Promotion Period” starts at 9.00am Monday 3 October 2011 and closes at 5.00pm on Wednesday 7 March 2012. Important times and dates are as follows:
- Instant prizes must be claimed by no later than 5.00pm on Wednesday 7 March 2012 or they will be forfeited and awarded in the 2nd Chance Prize Draw.
- Entry in the 2nd Chance Prize Draw closes at 5.00pm on Wednesday 7 March 2012.
- To participate in the promotion and have a chance to win a prize, it is necessary to purchase NESCAFÉ CAFÉ MENU as follows:
- For a chance to win an instant prize and enter the 2nd Chance Prize Draw, purchase any specially marked NESCAFÉ CAFÉ MENU pack that has a “Golden Cup” image on the packaging (“Golden Cup Promotion Product").
- For a chance to enter the 2nd Chance Prize draw only, purchase any NESCAFÉ CAFÉ MENU pack.
- To enter the 2nd Chance Prize Draw, register your contact and purchase details online at www.GoldenCup.co.nz by following the prompts to enter the last six digits of the NESCAFÉ CAFÉ MENU product barcode. (NOTE: Entry is limited to once per Eligible Purchase and the original purchase receipt will be required to claim any prize – keep purchase receipt(s) for every entry made safe until after the prize draw.)
- There will be a total of 10 specially marked NESCAFÉ CAFÉ MENU packs which will contain an instant win message printed and hidden inside the box. Note that only winning packs will contain a message which will include instructions on how to claim the instant prize via the toll free phone number 0800 830 840 by 5.00pm on Wednesday 7 March 2012. The instant win message will be invalid if the message is torn or otherwise rendered illegible.
- One entry in the 2nd Chance Prize Draw is permitted for each Eligible Purchase made. Any form of automated entry using any other devices or software is invalid.
- There are a total of 13 prizes to be awarded. Ten prizes will be available to be awarded via instant win message hidden inside specially marked NESCAFÉ CAFÉ MENU packs and three prizes awarded in the 2nd Chance Prize Draw. In the event that any instant win prize has not been claimed by the time and date notified at point 3(a) above, then that prize will no longer be available to be claimed as an instant prize and will be added to the prize pool to be awarded via the 2nd Chance Prize Draw.
- Prize Details - the prize is the winner’s choice of a personalised prize package valued at up to $10,000 maximum. Each winner will be invited to personalise their prize by choosing options that will be offered on the Prize Menu that will be subject to point 10 below, and any further prize details that appear on the Prize Menu on the www.GoldenCup.co.nz website. Prize items can only be chosen once and will include:
- Huka Lodge Alan Pye Cottage accommodation package for two people valued at up to $4,500 recommended retail price (“RRP”) including; pre-dinner drinks and canapés, superb five-course gourmet dinner presented within the cottage by own personal chef, lunch and full country breakfast, butler service, exclusive-use accommodation for one night in the Alan Pye Cottage for two guests (on a twin-share basis), use of all Lodge facilities and return Taupo Airport transfers. The prize package can only be taken between 1st May and 30th September 2012. Additional travel costs, mini bar and wines are not included in the package;

- A five-night travel package for two people to Hayman in the Whitsundays, Queensland valued at up to $10,000 RRP including; Return flights ex Auckland to Great Barrier Reef Airport (Hamilton Island) in the Whitsundays, as well as luxury launch transfers to Hayman staying in a Lagoon or Pool Suite (dependent on availability), daily beachfront breakfast in Azure restaurant, a Whitehaven Indulgence tour for two, including a heli flight over the Great Barrier Reef and $500 spending money for food in the resort;

- A ‘Me Time’ Indulgence Package valued at up to $500 RRP, which consists of NESCAFÉ CAFÉ MENU products, Trilogy products; including Everything Balm, Botanical Body Wash, Rose Hand Cream and Nourishing Body Lotion, 6 x Latté cups and saucers and Wallace Cotton products; including 2 x Oasis Bath Sheets, 2 x Oasis Face Cloths and 1 x Oasis Hand Towel.
- All prize items will be subject to the supplier’s terms and conditions. Prizes are non-transferable and cannot be exchanged for cash. Each winner must choose prize items from the Prize Menu up to a maximum prize value of $10,000, prize items can only be chosen once. Any variation between what the winners choose and the $10,000 maximum prize value will not be payable to the winner in cash or product, (there are a number of combinations of prizes that do equal $10,000 for a winner to choose from). However if a winner gets within $500 to the $10,000 value (ie, can only get to $9,500 and there are no more prizes at $500 value to add into their selection) then the Promoter reserves the right to top up the winner's prize selection with an additional $500 'Me Time' package. For any prize package that includes a voucher or credit the amount allocated must include any delivery or shipping charges. Any prize element that includes flights and/or accommodation will be subject to availability at time of booking. Additional spending money, meals, taxes, valid passports, visas, transport to & from departure point, additional transfers, insurance & all other ancillary costs are the responsibility of the winner. It is a condition of accepting any prize with a travel element that all components of the prize be taken during the trip and all persons taking the trip depart from & return to the winner's nearest capital city at the same time unless otherwise specified in the prize description details or otherwise agreed by the Promoter & that all persons taking the trip sign a waiver of liability & an indemnity in the form determined by the Promoter in its absolute discretion.
- All valid entries received during the Promotion Period will be entered into the 2nd Chance Prize Draw, which will occur at 10am on Wednesday 14 March 2012 in Auckland. The first three valid entries drawn will each win the prize. In the event that any instant prize remains unclaimed at the end of the Promotion Period then that prize will also be added to the prize pool and will be awarded in the 2nd Chance Prize Draw and the draw will continue until all remaining unclaimed instant prizes have been awarded.
- All winners in the 2nd Chance Prize Draw will be notified by telephone or email using the contact details provided in their online entry. The names and towns of instant prize winners and the winners of the 2nd Chance Prizes will appear at www.nestle.co.nz/winners by Friday 30 March 2012.
- The Promoter reserves the right to verify the validity of all instant prize claims and all entries in the 2nd Chance Prize Draw and reserves the right to disqualify any individual claimant or entrant or group of entrants for tampering with the prize claim process or entry process, including but not limited to fraudulently claiming an instant prize, or sending an entry that is not associated with an Eligible Purchase, or submitting an entry that is not otherwise in accordance with these terms and conditions of entry.
- The Promoter reserves the right to ask any participant that has won a prize (either an instant prize or a prize awarded in the 2nd Chance Prize Draw) to present their original purchase receipt showing an Eligible Purchase for every entry made in order to claim the prize.
- The Promoter reserves the right to ask any prize winner to provide proof of age and identity in order to claim their prize. In the event that a prize winner is under the age of 18 years, the prize will be awarded to the winner’s parent/guardian on their behalf.
- Prize values are correct at time of printing; no responsibility is accepted for any variation in the value of prizes.
- The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
- Each winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Consumer Guarantees Act 1993 [NZ]) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
- In the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure that item within New Zealand, the Promoter reserves the right to substitute a different prize item of equal or greater value.
- All entries become the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.co.nz or calling 0800 830 840.
- Prizes will only be delivered in New Zealand and winners should allow 28 days to receive their prize from the Promoter’s validation of the instant prize claim, or the 2nd Chance Prize Draw. If any element of the prize selected by a winner includes travel, that element of the prize must be fully redeemed within 12 months of the prize draw.
- Printing and other quality control errors will not invalidate an otherwise valid prize claim. Promotion Products and winning messages are void if they are stolen, forged, mutilated or tampered with in any way or they fail the Promoter’s validation test. There will be a total of 743,720 specially marked “Golden Cup” NESCAFÉ CAFÉ MENU Products printed for this promotion.
- If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
- Entries in the prize draw are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation or sending or receiving of any communication or of any materials in this promotion.
